Assumption of Inherent Risk (Restoration & Cleaning) 

The Client acknowledges and understands that card restoration, cleaning, polishing, surface normalization, flattening, and structural repairs (including corner/edge lift repair and dent reduction) involve complex physical and chemical manipulation of delicate paper, factory ink, and holographic foil layers. The Client explicitly recognizes that trading cards are subject to natural degradation, factory printing variances, and unpredictable chemical reactions. By submitting items to AWAKN TCG, the Client assumes all inherent risks of the restoration process, including but not limited to unintentional permanent alteration, layer shifting, color fading, or material degradation occurring during the normal course of processing. 

Limitation of Liability and Release 

To the maximum extent permitted by applicable state and federal laws (including the laws of Virginia, Maryland, and the District of Columbia), the Client hereby releases, waives, and forever discharges AWAKN TCG (including its owners, employees, and independent contractors) from any and all liability, claims, demands, or causes of action for accidental property damage, loss, or theft while items are in the physical custody of AWAKN TCG, except where such damage or loss is the direct result of proven gross negligence or willful misconduct.

Transit, Shipping, and Handling Waiver 

AWAKN TCG shall not be held liable or financially responsible for any items lost, stolen, delayed, or damaged while in transit via third-party shipping carriers (including but not limited to USPS, FedEx, UPS) or while in the custody of third-party grading submission services. The Client is solely responsible for electing, purchasing, and managing adequate shipping insurance to cover the full market value of their collectibles to and from the AWAKN TCG facility. 

Third-Party Grading Disclaimer

The Client acknowledges that any pre-grading evaluations, condition assessments, and condition sub-grade predictions provided by AWAKN TCG are strictly subjective professional opinions based on historical knowledge, experience, and forensic tool screening. Final grade determinations are made entirely at the sole discretion of independent third-party grading corporations (such as PSA, CGC, BGS). AWAKN TCG gives no guarantees, warranties, or promises regarding final grades received, financial valuations, or successful crossover attempts. The Client agrees that a variance between an AWAKN TCG pre-grade opinion and a final third-party grade does not constitute a breach of contract or an entitlement to a refund or damages. 

Severability and Governing Law

This Agreement shall be construed and governed in accordance with the laws of the Commonwealth of Virginia. If any provision or specific clause of this waiver is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain fully intact and enforceable to protect both parties.

CUSTODIAL STORAGE, POSSESSORY ARTISAN’S LIEN, AND STATUTORY ABANDONMENT POLICY

Upon receipt of an official completion notice via email, text, or messaging handle, the client is granted a complimentary seven (7) calendar day grace period to settle all outstanding invoice balances and finalize in-person retrieval or return delivery logistics; any property remaining in the custody of AWAKN TCG beyond this 7-day period shall automatically accrue non-refundable, daily insured custodial vault storage fees at a rate of $5.00 per card per day for days 8 through 30, and $10.00 per card per day for days 31 through 60, all of which attach directly to the master invoice and must be satisfied in full prior to the release of any items. To prevent excessive storage fees from accumulating, the client expressly authorizes AWAKN TCG to invoice and dispatch unretrieved items via insured, tracked carrier delivery to the physical address provided on this form if in-person hand-off is not finalized within fourteen (14) calendar days of completion. Pursuant to statutory artisan, bailee, and mechanic lien jurisprudence, the client expressly grants AWAKN TCG a first-priority possessory lien across all submitted assets to secure the full payment of all contracted conservation labor, accrued daily custodial vault storage charges, and administrative handling expenses. If an invoice remains unpaid, or if the client fails to take physical custody or arrange carrier delivery within ninety (90) calendar days following the initial completion notice, the property shall be deemed legally abandoned, granting AWAKN TCG full contractual and statutory authority to foreclose its possessory lien and liquidate the property via commercially reasonable private transaction or public sale to satisfy the accrued debt, with any net surplus funds remitted pursuant to applicable state unclaimed property laws and any remaining balance deficiency remaining the personal liability of the client, whereby the client expressly waives all future claims of conversion, civil theft, or detinue arising from the lawful execution of this possessory lien.
